Using the "Ships" sign: what the provisions of the traffic rules say

On April 1, 2017, amendments to the document entitled "Basic provisions for the admission of a vehicle to traffic" came into force. According to Decree of the Government of the Russian Federation No. 333 of March 24, 2017, paragraph 8 of this regulatory act was supplemented with a provision obliging owners of cars with studded tires to install a special warning sign "Spikes" on the car.

In accordance with paragraph 2.3.1 of the Rules of the Road, the operation of a vehicle that does not meet the Basic Provisions for admission to public roads is prohibited. This means that starting from April 2017, it is possible to drive a car with studded wheels only if there is an appropriate sign - drawn up in accordance with GOST and placed in accordance with the established requirements.

Sign "Spikes": dimensions according to GOST

The appearance of the "Spikes" warning sign has been chosen to make it as visible as possible to all road users. The image was based on an equilateral triangle with a bright red border and a large black letter "Ш" on a white background. At the same time, the state standard establishes the minimum dimensions of the sign and its elements:

  • the length of the side of the triangle is at least 20 cm,
  • the width of the red border is 1/10 of the length of the triangle (minimum 2 cm)

This format of the sign allows the use of its image on paper - plain or self-adhesive, as well as the choice of any size at the request of the car owner, but not less than the established minimums.

Where to glue the sign "Thorns"?

Paragraph 8 of the Basic Provisions for the Authorization of Vehicles to Participate in Road Traffic contains a phrase that obliges to install a sign warning of the presence of spikes “behind the vehicle”. In accordance with this, the choice of location for its placement will be limited to the surfaces of the rear window, trunk lid and bumper.

From a practical point of view, glass will be the best choice, since it is less prone to contamination than the trunk lid and bumper - a sign smeared with dirt will simply not be visible. In addition, the paper product itself will last much longer if it is pasted on the inside of the glass.

The current traffic regulations do not provide for any sanctions for an unsuccessfully chosen place for placing the “Ships” sign, therefore the driver must fulfill only two basic requirements:

  1. Have a sign made in accordance with GOST (size, color design).
  2. Place it "behind the vehicle".

Important! Experienced motorists always place the “Spikes” sign in a visible place and make sure that it is visible to other road users. Otherwise, he will not fulfill his role - to warn road users about the dangers caused by the installation of spikes on the wheels. The location of the sign "Spikes": which side to glue?

Since the regulations do not establish requirements regarding the side of the placement of the “Spikes” sign, one should be guided by the desire to make it the most visible to other road users. Obviously, for drivers who predominantly drive cars with a left-hand drive, the left side of the car in front will be the best place. Hence, the most optimal choice for the placement of the “Spikes” sign should be considered the lower left or upper left corner of the rear window.

On the roads you can find cars with warning signs of relatively large sizes. Recall that the dimensions of the sign "Spikes" on the rear window are regulated only in part of their minimum parameters. Therefore, we can only talk about aesthetic issues: theoretically, the owner of the car has the right to use the entire rear surface of the body of his car under the sign!

The question of where, according to GOST, the “Spikes” sign should be placed cannot be called correct, since the state standard establishes requirements solely for the appearance of the image, while the place of its installation is regulated by the Basic Provisions for the Vehicle’s Authorization to Participate in Road Traffic: “the driver is obliged to install the sign behind the vehicle."

Penalty for the absence of the sign "Spikes"

The changes made to the Basic Provisions for the admission of vehicles to movement in terms of the use of the “Spikes” sign automatically added the corresponding clause to the Code of Administrative Offenses. Thus, part 1 of Article 12.5 of the Code of Administrative Offenses now states that the penalty for the absence of the “Spikes” sign is 500 rubles. At the same time, the law allows for the replacement of a fine with a warning. The traffic police inspector can mitigate the sanction at his discretion.

The opportunity to get off with a warning in no way makes the article on the need to glue the “Spikes” sign formal: the introduction of a fine means that legislators consider the problem serious and will insist on punishing persistent violators. We must not forget that a vehicle that does not meet the requirements of the Basic Provisions for the Authorization of the Vehicle to Participate in Road Traffic is prohibited from operating on public roads. At the same time, avoiding any troubles, be it a fine or compensation for damage caused to someone else's car, is very simple: just buy or print the sign on a printer with your own hands and stick it on the rear window of your car.

For reference: Federal Law No. 437-FZ, which entered into force in 2016, makes it possible to halve the amount of the fine to be paid if the violator manages to pay it off within 20 days after the fine is issued. This 50% discount applies to a limited list of infringements, but sanctions for not wearing the Thorns sign are included in this list. This means that with a responsible approach to their civic duties, the fine for the “Ships” sign will be only 250 rubles.

How to make the sign "Spikes" according to GOST yourself?

To make the Spikes sign on your own, it is enough to have geometry skills, as well as to have a piece of paper and red and black markers on hand. To create a paper sign in the minimum allowable dimensions (with a triangle side width of 20 cm), an A4 sheet is suitable (its width is 21 cm.) The most important thing is to clearly observe the proportions regarding the length of the side and the thickness of the red border - 1 to 10. Use of the "Spikes" mark in other countries

When driving a car with studded wheels outside of Russia, you should remember that in most European countries, tires equipped with metal studs are prohibited by law. The reason is that such wheels destroy the road surface, therefore, in order to save on road repairs, European legislators establish requirements for winter wheels. However, the use of winter tires in winter in Europe is mandatory.

Somewhat different rules apply in Scandinavian countries. So, on the roads of Finland it is allowed to drive on studded wheels, but the law allows their use strictly from November 1 to March 31. There are also strict requirements regarding the number of spikes on the wheel and the “density” of their placement. In addition, legal regulations differ for different modes of transport (trucks, cars and motorcycles). For example, on a passenger car with 13-inch tires, it is allowed to install no more than 90 spikes protruding beyond the tread line by no more than 1.2 mm. There is no requirement that would oblige to install the “Spikes” sign on a car in European countries.

It must be remembered that in winter, customs inspection at automobile checkpoints to European countries necessarily includes an inspection of tires. If the tire has studs, and local laws prohibit their use, the entry for such a car into Europe will be closed. How do Europeans deal with the issue of crossing the border, for example, heading from Finland to a country where studded tires are banned? There are only two ways out of the situation:

  1. In advance, change tires for regular winter tires at the tire fitting nearest to the border.
  2. Rent a car that meets the requirements.

Foreigners who arrive in Russia in a car with studded tires are required to bring the vehicle in line with the requirements of Russian laws, that is, install the “Spike” sign on the car.

The traffic police of Russia reminded motorists that in the case of driving on winter tires with spikes, in addition to observing all precautions, it is also necessary to glue the corresponding mark on the rear window of the car - the “Sh” sign. Otherwise, the driver will have to pay a fine of 500 rubles.

The corresponding amendments to the SDA and the Code of Administrative Offenses came into force on April 4, 2017, and in the spring some motorists already had to pay to the treasury for the absence of a sticker. True, due to weather conditions and the lack of the need to drive on winter tires, there were few such “lucky ones”.

But with the onset of cold weather, drivers “changed their shoes” again, and most often, especially outside large cities, it is studded tires.

The State traffic inspectorate answers about the direct purpose of this sign: “its meaning is to inform drivers who drive behind that studded tires are installed on the car,” the department told Gazeta.Ru.

It turns out that each driver will decide for himself what to see in this warning - whether it be a possible shortened braking distance or the danger of meeting with stones flying out from under the wheels. The department also clarified that issuing a fine or a warning is at the discretion of the traffic police inspector: most likely, if a stopped driver of a car without a sticker, but with spikes, does not show serious traffic violations and unpaid fines, the traffic police inspector can simply warn him with peace of mind . At the same time, it is important to note that

in the event that the car is registered to a legal entity, and the inspector nevertheless decided to issue a fine for the absence of the notorious sign, then it is the driver who will have to pay, and not the organization.

So it is better for professional drivers to carefully study the transport they trust, and, in the case of using rubber on spikes, stick a triangle. By the way, you won’t be able to pass a technical inspection if you are on winter tires without this sign.

With the arrival of the cold season, some motorists complained about the lack of necessary stickers and decided to make them themselves.

As assured "Gazeta.Ru" in the State traffic inspectorate, there will be no claims with "handicraft" signs, the main thing is that they comply with the requirements established by law.

So, in the government decree of 10/23/1993 N 1090 (as amended on 07/12/2017) it is indicated that the sign "Spikes" should be in the form of an equilateral triangle of white color with the top up with a red border, in which the letter "Ш" of black color is inscribed (the side of the triangle is at least 200 mm, the width of the border is 1/10 of the side).

Despite different approaches to finding the right sign, motorists agree on one thing - in order not to run into a fine, it is better to stick the letter “Ш”.

Drivers will be forced to change their shoes

Despite the rule that drivers are required to drive in winter on winter tires, and not on summer tires, there is no penalty for this discrepancy.

In 2015, legislators proposed introducing a fine of 2,000 rubles. for such a violation, but the initiative was not supported. Theoretically, in this case, the traffic police inspector can issue a fine of 500 rubles for driving a vehicle in the presence of malfunctions. True, in the "List of malfunctions and conditions under which the operation of vehicles is prohibited" SDA, only tire wear is prescribed (Section 5 "Wheels and tires", paragraph 5.1). In the Code of Administrative Offenses, there are no rules regarding liability for not changing summer tires to winter ones.

Meanwhile, the participants of the Safe Roads project called for tougher responsibility for driving in winter on summer tires. “It is necessary to adopt a law on establishing a fine for the use of car tires out of season and to give the regions the opportunity to set their own tire life,” said Sergei, the Safe Roads coordinator.

According to the press service of the project, the adoption of this law will ensure traffic safety on Russian roads.

According to Bidonko, the introduction of fines for the use of car tires out of season will force motorists to switch to winter tires with the advent of cold weather.

“Also, such drivers significantly complicate road traffic, because in order not to get into an accident, they slow down. Of course, only the introduction of fines without educational work will not help, it is necessary to carry out this work annually in the media, social networks, so that drivers understand the importance and responsibility,” Bidonko explained.

As the deputy noted, work on a draft federal law on fines for the use of tires out of season has been underway since 2014.

Dimensions according to GOST, can I do it myself?

If you read the position, then it describes what it should be according to GOST - I repeat once again EQUILATERAL, TRIANGLE SIDE 200 mm, line thickness 1/10 of the side (i.e. 2 cm), and always red, and the letter “Ш” is black, must be on a white background .

Can it be done by hand? YES OF COURSE YOU CAN! The main thing is that it meets all the requirements and be made in accordance with GOST, be colored, etc. I mean, you can’t just print black and white on an A4 sheet. That is, we take a color printer and go.

However, I think it's better to buy for 30 - 50 rubles (in the capital, like up to 100) and stick it on the outside. The whole problem with the printed one is that you need to find a color printer, then somehow fix it (adhesive tape to help), and it turns out you need to install it inside because rain can wash it away from the outside.

There are misconceptions that it can only be mounted on the rear glass from above (right or left), but this is not entirely true. Neither in the article nor in the regulation is there a point where and how it needs to be fixed, the only thing that the traffic police can pay attention to is whether it is blocked by tinting (that is, it must be read otherwise they can slap a fine), and also, as one inspector told me that it needs to be read from 20 meters (although this is not in the law and regulations).

That is, to summarize - you can GLUE anywhere, even on the bumper, even on the back cover (let's say if you have a hatchback or station wagon, it's still not so convenient on a sedan). There will be no punishment here.

Sizes of a sign for self-production

The sign of spikes can be either purchased at the store or made independently. In this case, the following conditions must be observed:

Please note that this article refers to the presence of malfunctions or conditions under which it is prohibited to operate vehicles. In 2017, paragraph 8, which refers to the installation of the "Spikes" sign, refers to such malfunctions.

Therefore, the penalty for not having a Thorns sign is a warning or a fine of 500 rubles.

Passing technical inspection without the sign "Spikes"

In addition to the fact that a fine is provided for the absence of the "Ш" sign, this sign must also be installed during the technical inspection of the car. At the technical inspection, they just check the compliance of the car with the requirements of the Basic Regulations for the admission of vehicles for operation and the duties of officials to ensure road safety. So if there is no sign on the back of the car, the car will not pass the inspection, and the driver will be sent to the nearest store to get the sign.

So if you are planning to visit a technical inspection point, then purchase the Spikes sign in advance. Of course, there is another option - to install non-studded tires for the duration of the inspection. However, this is not very reasonable, given the small cost of the sign (around 50 - 100 rubles).
